Terms & Conditions

These terms apply to every service offered by Michaeil, for clients in the Netherlands, Belgium and any other country. By enrolling in a programme you confirm that you have read and accept these conditions.

1. General

Michaeil provides coaching to quit nicotine-based products and habits, including smoking, vaping, snus, waterpipe (hookah) and comparable forms of nicotine use. Guidance is delivered through in-person sessions, blended programmes and digital support. Services can be delivered online or on location, depending on what is agreed with the participant.

Deviations from these terms are valid only if explicitly confirmed in writing by Michaeil.

2. Definitions

Within these terms the following definitions apply:

  • Michaeil the coaching practice that offers stop-smoking programmes, registered with the Dutch Chamber of Commerce under number 77916964.
  • Participant any individual or organisation that enrols in Michaeil’s coaching or programmes, regardless of the country of residence.
  • Programme any form of guidance, trajectory, session or additional service provided by Michaeil.
  • Agreement the arrangement between Michaeil and the participant concerning participation in a programme.
  • Materials all information, documents, videos, tools and other content shared during the programme.

3. Enrolment & participation

Michaeil delivers coaching digitally, by phone and/or in person. Participants outside the Netherlands can take part fully, provided they have a reliable internet connection.

  • 3.1 Enrolment takes place via the sign-up form, e-mail or a personal intake. By registering, the participant warrants that the information supplied is accurate and complete.
  • 3.2 An enrolment becomes final once written or e-mail confirmation has been issued by Michaeil. Michaeil may refuse enrolments or request additional information.
  • 3.3 The participant confirms that participation is medically responsible. Michaeil may decline or pause participation if additional (medical) support is deemed necessary.
  • 3.4 Sessions can be delivered in Dutch or English. For international participants, language and time zone preferences are aligned in consultation.

4. Intellectual property

All materials supplied during the programme remain the property of Michaeil. Participants are not permitted to copy, distribute or use these materials for commercial purposes without prior written consent.

Access to digital environments or tools is personal and must not be shared with third parties.

5. Prevented attendance / early termination

If the participant cannot attend a session, Michaeil must be notified at least 24 hours in advance. Late cancellations or no-shows may be charged.

Michaeil may suspend or terminate a programme if the participant does not meet the agreed obligations or if continuation is not in the interest of the participant or Michaeil.

6. Privacy & research

Michaeil processes personal data in accordance with the privacy policy. Data is used solely for coaching, administration and anonymous evaluation.

Data is only used for research or statistics in anonymised form, unless the participant has given explicit consent for other use.

7. Cancellation

Cancellation must be submitted in writing or by e-mail. If cancelled within 14 days after confirmation and before the programme starts, no fee is charged.

After the programme has started, the full fee remains payable unless agreed otherwise.

8. Payment

Payment is due in advance or according to the payment terms stated on the invoice.

The stop-smoking programme fee is €421 per participant. This amount includes VAT for clients within the EU. Participants outside the EU/EEA (such as Switzerland and the United Kingdom) are charged 0% VAT or subject to reverse-charge mechanisms in accordance with local regulations.

International transaction costs, exchange-rate differences or bank fees are borne by the participant.

9. Liability

Michaeil’s coaching aims to support smoke-free living, but does not constitute medical treatment. Participants remain responsible for their own health decisions at all times.

Michaeil is not liable for indirect damage, consequential loss or loss of profit. Any direct damage is limited to the amount paid by the participant for the relevant programme.

By participating, the participant indemnifies Michaeil against claims from third parties arising from the use of advice or materials provided.

10. Complaints

Complaints regarding the execution of the agreement must be reported as soon as possible, but no later than 14 days after they arise, via e@michaeil.nl.

Michaeil aims to respond within 14 days. If more time is required, the participant will receive an indication of the expected response time.

11. Governing law & jurisdiction

Dutch law applies to these terms and to every agreement between Michaeil and the participant, regardless of the participant’s country of residence.

Any dispute will be submitted exclusively to the competent court in the district where Michaeil is established.
